Born in the U.S. – But Still Detained as “Illegal”

Juan Carlos Lopez Gomez, 20 years old and born in the United States, was arrested in Florida and detained as if he were an undocumented immigrant – even after a judge reviewed his birth certificate, state ID, and Social Security card, and dismissed the charges.
Stopped due to suspended law
Juan had been stopped in a car near the Georgia border under a controversial Florida law, temporarily suspended at the time, that criminalizes undocumented individuals entering the state.
He ended up in Leon County Jail, though he never should have been arrested in the first place.
When his mother presented his documents in court, Judge Lashawn Riggans immediately dropped the charge.
Still, immigration authorities at ICE refused to release him right away, instead issuing a 48-hour detainer – a procedure typically used for individuals without legal status.
“They saw a young man who didn’t speak English very well and applied a law that shouldn’t even be enforced,” said attorney Alana Greer of the Florida Immigrant Coalition.
The case has drawn widespread attention because ICE has no authority to detain individuals born in the U.S. Juan was eventually released after heavy media coverage – but his story highlights just how fragile citizenship can become when bias and bureaucratic error take over.
